No, these are only exceptions to the DMCA. Every game that was already copyrighted will still be under copyright as spelled out in the Berne Convention until the time it becomes public domain (not for a while!).

These exceptions would make it legal to reverse-engineer or cicumvent protections for obsolete software. That shouldn't have been made illegal by the DMCA anyways IMHO (even for non-obsolete stuff), which was a very recent law in US, so this changes nothing from my view.

This should, however, help clear up the grey area around flash carts and similar things for older systems (if one considers putting code in ROM to be a form of protection, I sure don't).
