I haven't used the > 8 sprite bit before, but the way the other bits work I'd expect it to either:

A - stay set until vblank
or
B - stay set until vblank, or until you read the register

But it should be set right before it renders the scanline with > 8 sprites, because thats when it has to evauluate the sprite positions.
